Terms of Service

These Terms of Service govern your access to and use of Eromantic AI and form an agreement between you and Eros Media LLC, 1000 Brickell Ave, Ste 715, Miami, FL 33131 ("we", "us" or "our"). By accessing or using the service, you agree to these terms. If you do not agree, you must stop using the service.

Eromantic AI is for adults only. You must be at least 18 years old, or the age of majority in your jurisdiction if higher, and legally permitted to use the service where you live. By using the service, you represent that you meet these requirements. Every companion is a fictional adult character aged 21 or older.

Eromantic AI is an AI companion service where adults chat with fictional companions, receive photos, voice messages and short videos from them, create custom companions, and generate private images and video. Access to features depends on your plan and available credits. Companions and their responses are generated by AI.

You may register with your email address or a supported sign-in provider such as Google. You authorize us to use the information you provide, including your email and username, to create and administer your account. Provide accurate information, protect your sign-in credentials, and contact support if you suspect unauthorized access. You are responsible for activity on your account and must not let anyone ineligible use it.

Do not request, generate, upload or share illegal or harmful content, or attempt to bypass our safeguards. Prohibited content includes depictions of minors or anyone appearing to be a minor; non-consensual sexual content, exploitation or rape; violence; and bestiality. Do not create deceptive real-person deepfakes, impersonate others, or use a real person's likeness without their consent. Do not infringe others' rights, harass, threaten, defraud, or misuse the service through automated or abusive traffic.

You are responsible for your inputs and how you use or share output. Violations can result in content removal, immediate suspension or termination, and referral to the authorities where appropriate. Report suspected abuse to support.

AI output depends on your inputs and may be inaccurate, unexpected or similar to output produced for others. We do not fully control model output and do not promise that it is unique, accurate, or eligible for copyright protection. You retain any rights you have in your inputs and must have permission to submit them. You allow us to process those inputs to provide the service, as described in our Privacy Policy.

You may share and use images you generate, including commercially, provided the use is lawful and is not intended to harm, defraud or negatively affect anyone. This permission does not grant rights in another person's intellectual property. Companion characters, their names and their portraits created by Eromantic remain our property.

Premium is a recurring subscription billed through our payment partner, Whop, until you cancel. Available plans, prices, billing periods and credit allowances are shown on the pricing page and at checkout, together with applicable billing details and taxes. Review those details before purchasing. By subscribing, you authorize recurring charges for your selected plan until cancellation.

Unlimited chat means text conversation while your plan is active, subject to reasonable-use limits to prevent automated or abusive traffic. Credits pay for photos, video, voice and other premium tools as shown in the app. Add-on credit packs are available separately. Members on a legacy plan keep that plan's price and allowance until they cancel it.

Credits do not expire. Credits granted or purchased remain in your balance after cancellation and can be spent without an active plan. Credits have no cash value and cannot be transferred. Credits associated with a refunded, reversed or charged-back payment are removed.

Credits spent on a completed generation are not refundable because you dislike the result. A generation that fails on our side is refunded to your credit balance automatically.

You can cancel at any time: open You > Subscription > Manage in your account to access your Whop membership, or cancel directly in Whop. Cancellation stops the next renewal. Your plan remains active until the end of the period already paid for, then your account returns to the free tier with your remaining credits intact.

We do not refund for slow generation or results you did not like. We consider refunds for double billing, charges after a confirmed cancellation, or a service that failed entirely. Where local law gives you a statutory right to withdraw from a purchase, that right applies. To request a refund, contact support from your account with the email you subscribed with. Failed generations are automatically refunded in credits as described in Section 8.

Affiliates earn a 25% commission on revenue from purchases made by users they refer, calculated on the revenue we receive after payment-processing fees. Affiliate terms shown in the affiliate dashboard apply in addition to these terms.

The service, its software, companion characters, logos, trademarks and other brand features belong to Eros Media LLC or its licensors. Subject to these terms, you may access and use the service through its provided features. Except for the permitted use of generated images described in Section 6 or as allowed by law, you may not copy, sell or exploit our intellectual property without permission. Unauthorized use may result in legal action.

Our Privacy Policy explains how personal information is handled. Our Cookie Policy explains our use of cookies and similar technologies. Read these policies before using the service and contact support with privacy or account-deletion requests.

To the extent permitted by law, the service and AI output are provided "as is" and "as available", without warranties of accuracy, fitness for a particular purpose, merchantability or non-infringement. We do not guarantee uninterrupted or error-free access. AI companions are fictional and their messages are not professional medical, mental-health, legal or financial advice. Use your own judgment when relying on output. These disclaimers do not exclude rights or warranties that cannot lawfully be excluded.

To the maximum extent permitted by law, Eros Media LLC is not liable for indirect, incidental, special, consequential or punitive damages, or loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the service. Nothing in these terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

To the extent permitted by law, you agree to indemnify Eros Media LLC against third-party claims, damages and reasonable expenses arising from your unlawful use of the service, your violation of these terms, or your infringement of another person's rights. This obligation does not apply to the extent a claim results from our own unlawful conduct.

We may remove content, suspend or terminate access if we determine that you have violated these terms, or where necessary to address illegal use or protect the service and its users. Credits on an account terminated for a violation are forfeited, subject to applicable law. You may stop using the service at any time, cancel your subscription as described in Section 9, and contact support to request account deletion.

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules, subject to any mandatory consumer protections that apply to you where you live. If you have a dispute with us, please contact support first so we can try to resolve it informally.

We may update these terms. The date above identifies the latest version. We will provide notice where required by applicable law. Continuing to use the service after updated terms take effect means you accept them. If you do not agree, stop using the service and cancel any subscription to prevent future renewals.
